I am about to lose my children to an abusive father if I cannot get the money to pay for an attorney and travel to the court hearing in Maryland.
My children have told me they are still being physically and mentally abused by their father. I took him to court in 2009 due to my children reporting to me that they were being abused and the courts found that I did not have enough physical evidence of the abuse due to the age of my children not being able to testify, and the lack of physical evidence such as pictures since we live in different states and I had been unable to obtain any proof other than my kids words. They are afraid of their father and do not want to go back to his home in Maryland. Their father and I separated, because he was abusive to me,and we could not resolve our differences . In 2003 the court determined we would have joint custody but gave him the priviledge to determine where the children would reside. Since he lives in Maryland, the custody order only allows me certain visitation times with the summer being the only reasonable time to get them due to school schedules and financial ability for travel.
When the children got here this summer, they began to tearfully tell me how their father was still abusing them, including hitting them with his fist. No child should be struck with a fist, but even worse, my maturing 12 year old daughter informed me that he has started hitting her in her chest with his fist leaving bruising that caused her to have to wear high necked shirts to cover them.
They are afraid to go back to him, pleading for me to keep them here in Brownwood, even asking if they could call Child Protective Services, which they did. I then contacted Child Protective Services (CPS)myself both here and in Maryland, and the local office has met with the children. I retained an attorney and a local judge issued an emergency protective order solely based on the childrens counselor and CPS reports, which allowed the children to stay with me past their scheduled time to return to their father along with an ordered court hearing, scheduled August the 9th. Both children are now seeing counselors, as both show signs of physical and emotional abuse including self mutilation and past suicide attempts when with their father . I have enrolled them in schools in Brownwood, and have got them involved in athletics including summer volleyball camp for my daughter and football for my son.
Although there is a court case set here in Brownwood, because the children are actually residence of Maryland, their father is making me take the case to Maryland. So the local court hearing may serve to delay the hearing in Maryland to give me time to prepare for a case in Maryland. Not only do I have to have an attorney here, but I also have to get one in Maryland immediately. If I cannot afford to get an attorney and be in Maryland on the court date, I lose my children automatically. The intent is obvously to drain me of all my finances so that I just have to surrender the children back to him without a fight. This will put the children back in the same abusive situation they were before. Jeffrey Yoder from CPS Texas, Mr Dewalt CPS in Maryland, my attorney Genetha Chastain and the kids counselors Vance Marcum and Kristy Leverette from the Taylor Clinic are doing everything in their power to help protect, comfort and prepare for court but I still need your help. I hate that I am in a financial situation where my children may end up back into an abusive home just because I can not afford to rescue them.
I beg of you as loving parents, or as just decent human beings, help me save my kids from the abuse they will certainly go back to without your help.
I anticipate costs at a minimum of $7,000 between the local attorney, the Maryland attorney, and travel to Maryland. That estimate is based solely on currently known costs.
